General Terms

Copyright

I will retain full copyright in accordance to the German Copyright Act (UrhG) since the copyright is non-transferrable. I also reserve the right to publish the finished work in my portfolio and on social media unless contractually explicitly specified and compensated for. The Client is able to request publication at a later date after completion of the work. Private Clients are also able to request for their project to not be published on social media for privacy reasons.

I do not claim the rights for any intellectual properties (IP) used in my work unless I am the author according to the German Copyright Act (UrhG).

Machine Learning

It is explicitly prohibited to use my work in any stage of production or publication for Machine Learning (ML), like in data sets for generative AI and similar technologies. Inability to comply results in legal action.

Fungible and Non-Fungible Tokens

It is explicitly prohibited to use my work in any stage of production or publication for fungible or non-fungible tokens (like crypto currencies and NFTs). Inability to comply results in legal action.

Payment Policy

The Client will receive an invoice upon each completion of the previously agreed upon stages of the project. The stages typically are 1) Concept, 2) Draft, 3) Preparation, and 4) Finalisation. The Client has 30 days to pay each invoice to assure continued work on their project. If the Client fails to pay their invoice within these 30 days, the project will be abandoned until they comply. If dues have not been payed after 120 days, I reserve myself the right to pursue legal action unless we managed to resolve the issue in a different manner.

Payment needs to be provided in Euro (€) to the bank account detailed in the invoice and the Client has to provide for any conversion or transaction fees that may occur.

Refund Policy

Due to the frequent feedback loops, projects will not be refunded for the service already provided. If the Client chose to pay for the full project up front, a refund is only available for parts of the project that have not already been provided.

Commercial Use

Licensing

Licensing is detailed by the individual work contract and depends on the individual project’s parameters such as purpose, scale of application, and usage, and will be compensated accordingly.

Private Use

Licensing

Private Clients are prohibited from using the commissioned work in any commercial manner, like selling or licensing it to any third parties, and require giving credits and linking to either a social media profile of inkythoughts art or this website whenever they post or display the work publicly (like as a social media post or profile banner/icon).
